These Terms & Conditions govern your use of our website and any purchases you make from Belle & Herbs Fermentary (“we”, “us”, “our”). By using the site or placing an order, you agree to these terms.

1) About our products

1.1 We produce fermented foods (e.g., kimchi, sauerkraut, pickles, chilli jam). Many items are raw/live and therefore perishable.
1.2 Ingredients, allergens and storage instructions appear on product pages and labels. Live products can continue to ferment and release natural CO₂; this is normal.
1.3 Packaging, weights, volumes and colours may vary slightly from images due to seasonality and supply.

2) Eligibility & your details

2.1 You must be 18+ to place an order.
2.2 You are responsible for providing accurate name, email, phone and delivery address details. We are not liable for losses arising from incorrect information supplied by you. If you spot an error after ordering, contact us immediately at hello@belleandherbs.farm or (0191) 280 3897.

3) Ordering, acceptance & communications

3.1 Your order is an offer to buy. A contract forms when we email your order confirmation and take payment.
3.2 We may decline or cancel all/part of an order (e.g., stock issues, a product fault, payment failure, pricing/description error, out-of-area address). Any sums captured for cancelled items will be refunded.
3.3 You will receive a dispatch email when your order leaves us. Courier notifications (time slots, tracking) are provided by the carrier and are outside our control.

4) Prices, delivery charges & promo codes

4.1 Prices are in GBP and include VAT where applicable.
4.2 Delivery charges appear at checkout and on our Delivery & Returns page.
4.3 We may change prices or run promotions at any time.
4.4 Promo codes (e.g., “WELCOME10”) are single-use per customer, non-transferable and have no cash value; they usually exclude sale items unless stated. We may withdraw or refuse codes in cases of misuse.

5) Payment

5.1 Payment is taken at the time of order. We do not offer credit.
5.2 We accept Stripe (cards) and PayPal. You don’t need an account to pay by card. Third-party processor terms apply.
5.3 Goods remain our property until paid in full.

6) Dispatch, delivery & risk

6.1 Dispatch times. Orders placed Mon–Fri before 12:00 (midday) usually ship the same working day. Orders placed after 12:00 on Friday or over the weekend ship on Monday (or next working day).
6.2 Services & estimates. UK Mainland orders use DPD Next Day (Food Service); other areas use equivalent weekday services. Timeframes are estimates; Bank Holidays and courier issues can add time.
6.3 Free delivery. UK Mainland orders of £50+ qualify for free delivery. Otherwise, a flat rate applies (shown at checkout). Highlands & Islands, Northern Ireland, Channel Islands, Isle of Man and other remote postcodes may carry surcharges and typically run on 48–72h services; free delivery may not apply.
6.4 Perishables in transit. Our ferments are preserved and tolerate ambient transit and short safe-place drops. On arrival, remove all outer packaging (including any grip/vac-seal bags) and refrigerate promptly for long-term storage.
6.5 Leakage. Natural CO₂ from live cultures may push a little brine out during transit; packaging/labels can be damp. This is normal and does not affect the best-before date. Unpack carefully, rinse items, and chill.
6.6 Damage or missing items. If anything arrives broken or missing, email hello@belleandherbs.farm with photos of the parcel and items within 48 hours of delivery. We will replace or refund affected items.
6.7 Do not reject deliveries. Please do not refuse parcels at the door. Rejected parcels can spoil on their return journey and we cannot refund rejected deliveries. Accept the parcel and contact us if there’s an issue.
6.8 Risk & title. Risk passes on delivery to your address/safe place. Title passes on receipt of full payment.
6.9 Late deliveries. We’ll help track and resolve delays and will replace orders lost or spoiled in transit, but we do not refund solely for lateness.

7.0 Authority to leave / safe place. Our DPD service may deliver to your address, designated safe place or a neighbour on the first attempt if you’re unavailable. Proof of delivery (photo/scan) will be provided by the carrier. Risk in the goods passes on delivery to the address, safe place or neighbour. If you prefer alternative instructions or a pickup point, update them via the DPD app/SMS tracking link on the day of delivery. For certain Friday dispatches we may use Royal Mail Tracked to avoid weekend depot holds; typical timing is 1–2 working days 

7) Cancellations, returns & your statutory rights

7.1 Perishable goods. Change-of-mind returns do not apply to perishable foods. Under the Consumer Contracts Regulations 2013, reg. 28(1)(d), the 14-day cooling-off right excludes goods liable to deteriorate or expire rapidly.
7.2 Non-perishables. Non-perishable items may be returned within 14 days of delivery, unused and in original packaging. You are responsible for return postage unless the item is faulty.
7.3 Faulty/not as described. Your statutory rights under the Consumer Rights Act 2015 apply (repair, replacement or refund where appropriate).

8) Subscriptions

8.1 Subscriptions renew on the schedule shown at checkout. You can pause/cancel in your account before the next renewal is processed.
8.2 Any introductory discount conditions for subscriptions (e.g., minimum number of renewals) will be stated clearly at checkout.

9) Product information & substitutions

9.1 We try to keep product photos and descriptions accurate, but seasonal variance and screen display differences may occur.
9.2 We may, where necessary, supply the same total weight/volume using alternative pack sizes (e.g., 2 × 1 kg instead of 1 × 2 kg) at no extra cost.

10) Website use & user content

10.1 You must not misuse the site (e.g., introduce malware, attempt unauthorised access, scrape content).
10.2 Content on the site is owned by us or our licensors; you may not copy it without permission.
10.3 If you interact with our social feeds and your content appears on our site, you grant us a non-exclusive, royalty-free licence to display that content on our website and social channels. This does not transfer ownership.

11) Privacy & cookies

11.1 We process personal data as described in our Privacy & Cookies Notice (see footer link).
11.2 We send necessary service emails about your order. Marketing emails are sent only with your consent and include one-click unsubscribe.

12) Liability

12.1 Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be limited.
12.2 Subject to 12.1, we are not liable for: (a) losses not caused by our breach; (b) business losses; (c) delays or failures outside our reasonable control (including courier delays, strikes, extreme weather).
12.3 Always follow label and storage instructions. Live ferments can be pressurised; open with care.

13) Changes to these terms

13.1 We may update these terms from time to time. The version published on our website at the time of your order applies to that order.

14) Governing law

14.1 These terms are governed by the law of England and Wales. Courts of England and Wales have exclusive jurisdiction.
